Trading Terms and Conditions of PeopleBank The Employment Network, part of H R Information Ltd ("PeopleBank")

PeopleBank is registered with the Data Protection Registrar: Registration number: X3549162
and is fully compliant with the Data Protection Act 1998, effective 24 October 1998. PeopleBank is registered for the purpose of 'the collection and dissemination of the details of persons seeking employment through various employment agencies and employers' job descriptions with the aim of matching one to the other'. A full list of PeopleBank data processing purposes, approved by the Data Protection Registrar, can be viewed at www.dpr.gov.uk.

The following terms and conditions of trading are deemed as acceptable by a PeopleBank Candidate and consent to data process information, as provided by a candidate, is given. Such consent is stated on selection of the 'I have read and accept the terms and conditions' drop down text box followed by the clicking on the 'proceed' button, at the CV registration page.

1. Obligations of H R Information Ltd (trading as PeopleBank The Employment Network)

(a) PeopleBank agrees to use its best endeavours to reconcile Job Specifications with Candidate Information through the PeopleBank System.
(b) to comply with the Data Protection Act, 1998.

(c) No sensitive data will be sought concerning racial or ethnic origin, political opinions, religions or other beliefs, trade union membership, health, sex life and criminal convictions.
(d) Personal data will only be transferred to third party countries (non EU) if those countries ensure an adequate level of protection for the rights and freedoms of data subjects.
2. Obligations of the Candidate
The Candidate agrees:

(a) to provide Candidate Information which is in all respects true and is not, in any respect, misleading, deceptive or inaccurate or likely to mislead or deceive.
(b) to request removal of Candidate Information from the PeopleBank System if the candidate ever becomes unavailable for employment or for other reasons wishes to be excluded from the PeopleBank System;
3. Acknowledgements, warranties and representations
The Candidate acknowledges that:

(a) the Candidate takes responsibility for the accuracy or otherwise of the Data it supplies;
(b) no proprietary right accrues to the Candidate in any software, information, material or methods supplied by PeopleBank;
(c) Candidate Information will be provided by PeopleBank to Employers in the course of the operation of the PeopleBank System;
(d) the Candidate has not relied upon any warranty representation or assurance which may have been given by PeopleBank as to the success of the PeopleBank System;
(e) that PeopleBank may alter or delete Candidate Information at any time without prior notice;

4. Indemnity

The Candidate indemnifies PeopleBank The Employment Network against claims brought against PeopleBank by a third party and damage suffered by PeopleBank in respect of PeopleBank's or an Employer's use of any Candidate Information including claims relating to the Data Protection Act, 1998.

5. Governing law, jurisdiction and representation

This agreement is governed by the laws of the United Kingdom and the parties irrevocably submit to the jurisdiction of its courts.

6. Disclaimer

Subject to the provisions of the Unfair Contract Terms Act 1977, the Supply of Goods and Services Act, 1982 and otherwise by law, PeopleBank The Employment Network disclaims all warranties in relation to the PeopleBank System, the software and the Data including all warranties implied by law or statute in relation to merchantable quality and fitness for purpose.
